PlayDraft Terms of Use

1. These Terms

These Terms of Use are an agreement between you and OverscrollTactics LLC ("OverscrollTactics," "we," "us"), the company that operates PlayDraft. By creating an account or using the PlayDraft app, you agree to these Terms. If you do not agree, do not use PlayDraft.

PlayDraft is distributed through the Apple App Store. Apple’s standard licensed-application terms also apply, and Apple is a third-party beneficiary of these Terms with the right to enforce them.

2. Who Can Use PlayDraft

You must be at least 13 years old to use PlayDraft. PlayDraft is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If we learn that an account belongs to a child under 13, we may suspend the account and delete associated personal information as required by law.

3. Your Account

You can sign up with an email address or with Sign in with Apple. You are responsible for activity on your account.

You choose a public username. We may reclaim or change a username that impersonates someone, infringes someone’s rights, or violates these Terms.

You can permanently delete your account at any time in Settings. Deletion is irreversible: it removes your account and personal data and removes you from your leagues.

4. Your Content

PlayDraft includes places where you create content: draft-room and league chat (including text, GIFs, and photos), custom draft topics, your username, and your profile photo ("User Content").

You own your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit it as needed to operate PlayDraft — for example, showing your messages to the people in your draft room or league. If you choose to export a share image of a draft board, you are choosing to share that content outside PlayDraft.

You agree not to post content that is unlawful, hateful, harassing, threatening, sexually explicit, or that infringes anyone’s rights (including copyright, trademark, and privacy rights), and not to impersonate others or spam the service. Hateful, harassing, or explicit content has no place on PlayDraft and violates these Terms.

5. Moderation and Reporting

PlayDraft hosts User Content and does not pre-screen it. What other people post is their responsibility, not ours.

You can block any user — their messages and photos stop being shown to you immediately — and you can report any message to us. Reports are submitted to us for review.

We may, but are not obligated to, review, remove, or restrict any User Content, and we may suspend or terminate accounts that violate these Terms. League commissioners can also remove members from their own league.

We may use automated systems and service providers to help detect, classify, prioritize, and review suspected violations. Automated outputs may inform, but do not necessarily determine, enforcement decisions.

6. DraftCoins, Tickets, and Virtual Items

PlayDraft uses virtual items: DraftCoins, draft tickets, Podium Boosts, XP, cosmetic avatars, and similar. Virtual items are licensed to you, not sold — they are not your property, have no cash value, are non-transferable, and can never be redeemed for money or anything of value outside PlayDraft.

Every DraftPack (topic list) in PlayDraft is free. Purchases only affect how many drafts you can run and which draft modes you can enter — never access to content.

PlayDraft has no gambling, no wagering, no prizes of monetary value, and no randomized paid rewards.

To the extent permitted by applicable law, we may change, rebalance, or discontinue virtual items and the in-game economy (including earn rates, prices in coins, streaks, and prestige). We will not charge you for an item and fail to deliver it.

7. Purchases

Real-money purchases are processed by Apple through your App Store account, and Apple’s payment and refund policies apply. We do not receive or store your payment details.

8. Referral Program

Referral rewards (for example, a free draft ticket for you and a friend who joins with your code) are a promotional program. We may change or end the program at any time and may withhold or reverse rewards obtained through abuse.

9. PlayDraft Content and Third-Party Names

The PlayDraft app, brand, artwork, and content are ours or our licensors’ and are protected by law. These Terms do not give you any right to use them outside the service.

PlayDraft is an independent game and is not affiliated with, sponsored by, endorsed by, or licensed by any athlete, artist, contestant, team, league, network, studio, publisher, platform manufacturer, or other person or organization referenced in the app. Names, titles, and trademarks are used solely to identify and comment on their respective subjects. All third-party trademarks remain the property of their respective owners.

10. Copyright Complaints

If you believe content on PlayDraft infringes your copyright, email rdeboer@overscrolltactics.com with the content, its location in the app, and your contact information, and we will review the complaint.

We may remove content that we determine infringes copyright, and we may suspend accounts that repeatedly infringe.

11. Third-Party Services

PlayDraft uses third-party services to operate, including GIF search powered by GIPHY, Apple services for sign-in, purchases, and notifications, and hosting infrastructure for accounts and data. Content you open through a share action (for example, posting a board to X) is governed by that platform’s terms.

12. Ending or Changing PlayDraft

You can stop using PlayDraft, or delete your account, at any time. We may suspend or terminate accounts that violate these Terms, and we may modify or discontinue features or the service itself. Sections of these Terms that by their nature should survive (including Sections 4, 6, 9, 13, 14, and 15) survive termination.

13. Disclaimers

PlayDraft is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that any content — including other users’ content and draft results — will be accurate or acceptable to you.

14. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. To the fullest extent permitted by law, our total liability for all claims relating to PlayDraft is limited to the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars ($50).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of PlayDraft, or your violation of these Terms or of someone else’s rights.

16. Changes to These Terms

We may update these Terms as PlayDraft evolves. If we make material changes, we will update the "Last updated" date and surface the change in the app. Continuing to use PlayDraft after changes take effect means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules.
